Labirinto de Injustiça - O falhanço na protecção das mulheres Indígenas da violência sexual nos EUA

[Da Amnistia Internacional] Mais de um terço das mulheres indígenas do Alaska e do restante território dos Estados Unidos foram violadas em algum momento da sua vida. A maioria não recorre à justiça sabendo que a resposta mais provável será a indiferença ou a inacção. As mulheres que recorrem à justiça veêm-se confrontadas com uma rede jurisdicional que passa pelos sistemas judiciais tribal, estatal e federal, acabando por tornar o processo moroso e complexo impedindo, por fim, o acesso destas à justiça.

A violência sexual contra as mulheres é claramente uma violação dos direitos humanos. Segundo estatísticas do governo estadual, a probabilidade que as mulheres indígenas dos EUA têm de ser violadas é mais de duas vezes e meia superior à das mulheres não indígenas. Embora haja algumas lacunas nos dados sobre violência sexual perpetrada contra estas mulheres, sabe-se que os responsáveis são tanto indígenas como não. A violência sexual sobre estas mulheres é resultado de vários factores. Primeiro, existe um legado de violações atrozes contra os povos indígenas dos EUA durante a "era das colonizações".

Segundo, os instrumentos legais que (não!) são postos à disposição das mulheres indígenas contribuem muito. Apesar do governo dos EUA ter uma responsabilidade legal de proteger os direitos e o bem estar dos povos indígenas, incluindo uma responsabilidade fiduciária de ajudar os governos tribais a salvaguardar a vida das mulheres indígenas, os organismos tribais encarregados de fazer cumprir a lei continuam a sofrer de uma escassez crónica de recursos, mesmo aqueles destinados ao Serviço Indíge na de Saúde, sendo que não é garantido às sobreviventes o acesso aos cuidados médicos necessários. Por outro lado existe também uma falta de formação adequada por parte dos agentes da autoridade, sejam eles federais, estatais ou tribais, o que acaba por limitar o direito destas mulheres a obter justiça.

Agir Já! Escreva às autoridades dos EUA para que abusos sexuais contra mulheres indígenas sejam adequadamente investigados, e para que as vítimas tenham acesso gratuito e adequado a assistência médica e legal.

Native American and Alaska Native women in the USA have long been calling on the federal government to take action to address violence against Indigenous women. In 2005 these efforts resulted in the Violence Against Women Act (VAWA) for the first time including a specific Tribal Title that seeks to improve safety and justice for Native American and Alaska Native women.

Amnesty International is, therefore, calling on the federal government to act immediately to fulfil all the commitments they have made to Indigenous women’s human rights de fenders including fully funding VAWA. This would include:

- Carrying out a study that provides a comprehensive understanding of the true scope and nature of sexual violence against Indigenous women including the legislative and jurisdictional barriers Indigenous women survivors of sexual violence face while attempting to find justice and redress
- Ensure that financial and other resources are available to provide critical services to Indigenous women who are survivors of sexual violence.

We appeal on you to investigate and study the treatment of crimes of sexual violence against indigenous women in cooperation with the community and women’s rights defenders.

We also urge the federal and state government to eliminate the legal obstacles in collaboration with the tribal governments so that these women can have easy access to justice. Women who survived such abuses should have adequate and free access to medical care.
